CNN —A Georgia state Senate committee investigating allegations of wrongdoing by the Fulton County District Attorney Fani Willis heard more than three hours of testimony from defense attorney Ashleigh Merchant that largely went unchallenged by the mostly Republican committee and offered little to no new information about the claims. Merchant is representing one of Donald Trump’s co-defendants in the sprawling 2020 Georgia election interference racketeering case and is seeking to have Willis, a Democrat, removed from the case, possibly endangering the entire prosecution. Republican state Sen. Bill Cowsert, chairman of the committee, told CNN that endgame of the panel is, “to determine whether there has been improper behavior. They’re going hear the evidence…and I’m sure both sides will actually do their role in that particular situation,” Jones said. The panel can amend Georgia law or create new legislation but lacks the power to directly sanction Willis.

CNN —The Georgia state Senate on Friday passed a resolution creating a special committee to investigate Fulton County District Attorney Fani Willis amid allegations of an improper affair with her lead prosecutor in the 2020 election subversion case against former President Donald Trump. The resolution, which cleared the GOP-controlled state Senate 30-19, allows the special committee to subpoena people and evidence while putting witnesses under oath for their testimonies. “This resolution is about an officer of the state of Georgia, within a subdivision of the state of Georgia, and how they are using state funds,” Dolezal said on the Senate floor. Willis and Wade have not directly addressed the accusations, and the Fulton County district attorney’s office has not yet commented on the allegations specifically. The judge overseeing the case against Trump has given Willis until the end of next week to reply in writing to the allegations to the court.

Atlanta CNN —Former President Donald Trump’s attorneys in the Georgia election subversion case are set to defend their client in a Fulton County courtroom for the first time on Friday as they try to have the charges thrown out on First Amendment grounds. This is the first time Trump’s attorneys will appear in court in the Fulton County case, though their client won’t be with them. Trump hasn’t yet been in the Atlanta courthouse – he previously waived his right to an arraignment hearing – though he was processed at the Fulton County jail in late August. She used a similar legal strategy in a 2014 RICO case in Fulton County, according to a source familiar with the matter. Despite his mounting legal debt and the fact that he is almost 80, sources close to Giuliani said he intends to fight the Georgia case.

Georgia has "made great strides since 1965 towards equality in voting," the judge wrote, referring to the year the Voting Rights Act was enacted to ensure Black voter power was not diluted through racially gerrymandered congressional and state legislative maps. Once the maps are drawn, litigants can still sue under the Voting Rights Act to demand the drawing of districts that are not designed to dilute minority voting power. The state is expected to appeal, but in a similar case in Alabama, the high court ruled for voting rights activists. "I applaud the district court's decision ordering Georgia to draw maps compliant with the Voting Rights Act," Georgia state Senate Minority Leader Gloria Butler, a Democrat, said in a statement responding to the ruling. A similar case is going on in Louisiana, which was also ordered to draw another majority-Black district.

ATLANTA (AP) — A Georgia state Senate committee says it will start its own investigation of jail conditions in the state's most populous county, three months after the U.S. Justice Department unveiled its own inquiry of Fulton County jail conditions. “Now, we can’t solve all the problems that Fulton County may have, or any other county for that fact,” Albers said. Fulton County's main jail, which opened in 1989 in a neighborhood west of downtown Atlanta, has been plagued by overcrowding, unsanitary conditions and violence. Six people have died in Fulton County custody since the end of July. Fulton County Commission Chairman Robb Pitts has said he wants to seek other solutions, in part because such an expensive undertaking would probably require a tax increase on Fulton County's million-plus residents.
